Terms of Service

These Terms of Service ("Terms") govern the relationship between StayPH("we", "us", or "StayPH"), a service operated by Gonzales Transient House, and the property owners and operators ("Clients") who subscribe to our booking website services.

By subscribing to StayPH services or signing our onboarding form, you ("Client") agree to be bound by these Terms. Please read them carefully before proceeding.

1. Introduction

StayPH is a Software-as-a-Service (SaaS) platform that provides professional booking websites for property owners in the Philippines. Our services enable hotels, transient houses, apartments, and other short-term rental properties to accept online bookings, manage availability, and process payments through a hosted website.

By using StayPH services, you acknowledge that you are a property owner or authorised representative with full legal authority to enter into this agreement.

2. Service

StayPH provides the following services to Clients:

  • A fully hosted booking website for your property at a [slug].stayph.ph subdomain (or a custom domain you provide).
  • An admin panel to manage bookings, availability, pricing, and website content.
  • Payment processing setup via GCash (through PayMongo).
  • Automated guest and host email notifications.
  • Ongoing maintenance, updates, and technical support.

StayPH reserves the right to update, modify, or improve the platform at any time. We will notify Clients of significant changes that may affect their service.

3. Payment

StayPH charges a one-time setup fee upon onboarding, and a monthly subscription fee for ongoing access to the platform. Specific pricing is agreed upon at the time of onboarding.

All payments are made via GCash to the StayPH account. Payment details will be provided at the time of invoicing.

Setup fees are non-refundable once your website has been built and made live, regardless of whether you subsequently cancel your subscription.

Monthly subscription fees are due at the beginning of each billing period. Failure to pay within 7 days of the due date may result in suspension of your website until payment is received.

4. Subscription & Cancellation

StayPH subscriptions are billed on a monthly basis. Your subscription automatically renews each month unless cancelled.

You may cancel your subscription at any time by providing at least 30 days' written noticevia WhatsApp or email to StayPH. Cancellation requests made with less than 30 days' notice will take effect at the end of the following billing period.

Your website will remain live and accessible until the end of the current paid billing period. After cancellation, your website will be taken offline and your data will be retained for 30 days before deletion.

No partial refunds are issued for unused days within a billing period.

5. Client Responsibilities

As a Client, you agree to:

  • Provide accurate information: Ensure that all property information, pricing, availability, and contact details on your website are accurate and up to date.
  • Comply with Philippine law: Operate your property in compliance with all applicable Philippine laws and regulations, including local government permits and tourism accreditation requirements.
  • Respond to guests: Respond promptly to guest enquiries and booking-related communications. StayPH is not responsible for communication failures between you and your guests.
  • Maintain your GCash account: Ensure your GCash account is active and able to receive payments from guests. StayPH is not liable for failed or delayed payments due to GCash account issues.
  • Provide accurate payment details: Ensure your GCash number and account name are correct. Incorrect payment details that result in misdirected funds are your responsibility.
  • Keep your account secure: Maintain the security of your admin panel login credentials.

6. Content

You retain full ownership of all content you provide to StayPH, including property photos, descriptions, pricing information, and other materials ("Client Content").

By providing Client Content to StayPH, you grant us a non-exclusive, royalty-free licence to display, reproduce, and use that content solely for the purpose of operating and promoting your website on the StayPH platform.

You confirm that you have the right to use all content you provide, including photos, and that it does not infringe any third-party intellectual property rights.

7. Availability & Uptime

StayPH aims to maintain 99% uptime for all hosted websites. We perform maintenance during low-traffic periods and will endeavour to provide advance notice of scheduled downtime.

However, StayPH is not liable for service interruptions caused by factors outside our reasonable control, including but not limited to: third-party hosting provider outages, internet infrastructure failures, DDoS attacks, or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by Philippine law, StayPH is not liable for:

  • Booking disputes between you and your guests, including cancellations, refunds, or disputes over property condition.
  • Payment issues arising from GCash, PayMongo, or other payment processors, including failed transactions, chargebacks, or account limitations.
  • Loss of revenue, loss of bookings, or business interruption caused by service downtime or technical issues.
  • Inaccurate information on your website if you failed to update it.
  • Any indirect, consequential, or incidental damages arising from your use of the StayPH platform.

Our total liability to you for any claim arising from these Terms shall not exceed the total amount you paid to StayPH in the 3 months preceding the claim.

9. Termination

StayPH reserves the right to suspend or terminate your service immediately, without prior notice, in the following circumstances:

  • Non-payment of fees after 7 days past the due date.
  • Violation of these Terms of Service.
  • Use of the platform for illegal or fraudulent activities.
  • Repeated guest complaints that damage the reputation of StayPH.

Upon termination, your website will be taken offline immediately. Any fees paid are non-refundable.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Baguio City, Philippines.

11. Amendments

StayPH may amend these Terms at any time. We will notify active Clients via email or WhatsApp at least 14 days before any material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
